It’s actually worse stress-wise as it is a mental health treatment court.  My assistant called over at 430 during the staffing panicking about it.   Thank you for the offer.  I mostly wanted to confirm my belief that the condition is goofy.

Can you address the issues with the treatment court judge or even at staffing. It certainly seems like an unreasonable request for someone who is interested in treatment. And added stressor for someone under addiction. I’m on our treatment court team here I know all counties are different but I’d be happy to discuss the matter with you. Have not debriefed our “team” member yet.  My guess it that the megalomaniacal Probation Officer running it pushed it as the ADA is about as reasonable as they get and would understand the problems this would create

That seems outside the parameters of what can be ordered by treatment court teams. Is this to get into treatment court or for someone who is already in? Is the DA pushing that condition?

If they are intending to call your client against another client that is a clear conflict issue. But you would have ethical obligations to inform the other client. This is tough.

Anyone have a situation where a treatment court imposes a condition that a treatment court participant must testify against another defendant?   And what do you do if that other defendant is represented by your office other than conflict the “other defendant.”.
