If he is being investigated I completely understand your concerns. It seems he would have a conflict if it’s the same department that would be investigating him. Could you seek an ethics opinion?

Subject: mdj issue - suspected criminal investigation

I have concerns about a sitting MDJ who I suspect may be currently under investigation by the DA’s office after the young child of his live-in girlfriend injected drugs that the child is alleged to have picked up on his couch.  This is a very recent event.  The child lived.

MDJ has agreed not to run again so he is done at the end of this year.  In fact, one of my assistants obtained the signatures for both Republican and Dem and is the only person on the ballot so she will be taking his place.  Until then, I have concerns about the MDJ’s decision making and whether he will side with the Commonwealth only because he fears criminal charges for he or his girlfriend.  While he has  had issues for years, historically he wasn’t too bad to appear before from a defense perspective.    What are your thoughts?
