We use a substantial hardship standard. It does not look like the defendant would suffer substantial hardship if required to retain counsel .

I received an application that had me up in the air a little bit about eligibility. The individual's monthly income is below our guidelines. However, the person has a completely paid for home valued at $180,000.00, over 2 months income in a checking account and has a small IRA. The liquid assets alone are enough to pay counsel in my county for the 1st offense DUI that is charged and still leave a months income in the account. I'm leaning toward rejecting because of the assets. Your thoughts?
