in  Centre we take all the pvs without application.  the court appoints us on all the state inmates with new charges.  they appoint us on all the failure to appear bench warrants and pfa violation arraignments (just for that appearance) if if they get released we tell them they have to make an appointment and qualify before we will represent them further.  we  print copies of our applications for our jail and they pass them out in intake.  we do not verify what they put down as income.  if they are in another county we will mail them or fax the jail an application if they want us.  if filling out and returning an application is problematic we just ask the court to appoint us.  if someone gets out on bail at the prelim.  we tell them that they need to make an appointment and qualify before we will enter an appearance and represent them at arraignment.
moving to withdraw on improved financial circumstances after an appearance has been entered is a waste of time here.

I have only turned down one prison application and that was because he revealed he had quite a hefty teacher's pension which he was still receiving,  I insisted that a private attorney would  most likely be happy to draw him up a POA so someone else could access it for him.  I was right.

In Clearfield, I will approve those incarcerated who most likely would not qualify if out due to income or assets as pre-lim only. We do nothing to cause our appearance at the Court of Common Pleas. Our acceptance letter tells the client that they must reapply once out if continued representation is desired. This places the responsibility upon them and therefor requires no follow up on our part.

Based on long followed policies, we do a financial intake of incarcerated clients. We also designate some cases where we think the client may not qualify if not incarcerated "more financial if released". The fact of the matter is that we don't usually follow up.

The policy creates some issues in the local prison and many issues with clients who are incarcerated elsewhere.

I would like to change our process to taking any incarcerated client who requests representation, particularly for fast turnaround matters like VOPs.

If any of you have a system that makes intake more relaxed but weeds out incarcerated clients who are clearly not indigent could you share the information?
